By creating an account, downloading, or using FuneralGuestbook.app (the “App” or “Service”), you agree to these Terms. These Terms are between you and Funeral Link LLC (5900 Balcones Dr, Ste 100, Austin, TX 78731), which operates funeral.link and FuneralGuestbook.app. If you accept on behalf of a funeral home or organization, you represent that you are authorized to bind it, and “you” means that organization. If you do not agree, do not use the Service.
FuneralGuestbook.app is an iPad guestbook that captures guest signatures, transcribes them into structured contact data, and provides a dashboard, exports, and optional follow-up tools. We may improve, change, or discontinue features over time, and will give reasonable notice of material adverse changes.
You are responsible for all activity under your account and for keeping your credentials and staff PIN secure; notify us promptly of any unauthorized use. The App is typically run as a shared kiosk signed by many guests — you are responsible for supervising the device at your service, ensuring the guest notice and consent screen is presented to each guest, and ensuring one guest's information is not exposed to the next. Keep your account information accurate and current.
Because you (the funeral home) decide how guest data is used, you are responsible for the lawfulness of collecting and using it. You will obtain the consent and provide the notice the law requires before guest data is collected, including presenting the in-App notice and not pre-selecting any optional marketing opt-in. You will use guest data only for lawful, disclosed purposes. You are solely responsible for your own outreach: if you contact guests by phone, text, email, or mail, you must comply with all applicable laws — in particular the TCPA (marketing calls and texts generally require prior express written consent; a guestbook signature alone is not sufficient), CAN-SPAM for commercial email, and Do-Not-Call rules. You will honor guest privacy requests, and we will help you fulfill verified ones.
Use the Service lawfully and respectfully. Do not misuse guest data, send communications beyond what guests consented to, upload others' data without authority, attempt to disrupt, reverse-engineer, decompile, or circumvent the Service or its security, or use the Service to build a competing product.
As between you and us, your account data and the guest data you collect are yours; we claim no ownership of them. You grant us a non-exclusive license to host, process, transcribe, and use that data to provide, support, secure, and improve the Service and our products, services, and technologies — including developing, training, and improving our AI and models — and to create and use de-identified and aggregated data for any lawful business purpose. We own the Service itself — the App, software, models, designs, and marks (including “FuneralGuestbook.app” and “funeral.link”) — and reserve all rights not expressly granted. Our handling of personal information is described in the Privacy Policy.
funeral.link is your software vendor and the provider of the Service. We use guest data to deliver the Service to you and — as described in the Privacy Policy — to operate, secure, improve, and develop our products, services, and models, including using de-identified or aggregated data. This Agreement does not fix a single privacy-law role for every purpose; where you require a service-provider or processor arrangement for your own compliance, a data processing agreement is available on request and, where signed, governs guest-data processing to the extent of any conflict.
Your first three services are free. Paid plans are billed monthly or annually as selected; annual plans are billed once for the year. Plans renew until cancelled, and you can cancel anytime — access continues through the paid period. Funeral-home subscriptions are billed directly (not through Apple in-app purchase).
You represent that you have the authority and the necessary consents to collect and process guest data through the Service. The Service is provided “as is” and “as available.” To the maximum extent permitted by law, we disclaim implied warranties, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that transcription will be error-free or that the Service will be uninterrupted. You are responsible for reviewing transcribed data for accuracy before relying on it. Nothing here disclaims liability that cannot be disclaimed by law.
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from the Service. Our aggregate liability will not exceed the greater of the fees you paid in the twelve months before the claim or US$100. Some jurisdictions do not allow these limits, so they may not fully apply to you.
You will defend and indemnify funeral.link against third-party claims arising from your collection or use of guest data in violation of law or these Terms (including failure to obtain required consent or non-compliant calling, texting, or email outreach), your breach of these Terms, or your data.
These Terms apply while you use the Service. Either party may terminate on reasonable notice or for material breach. You may stop using the Service and delete your account at any time, including from within the App. On termination, we will return or delete your data, subject to any retention the law requires — and we will tell you when such an exception applies.
When obtained through the Apple App Store, the App is also subject to Apple's standard Licensed Application End User License Agreement. This agreement is between you and funeral.link only — not Apple; funeral.link, not Apple, is solely responsible for the App and its content and support. You represent that you are not located in a U.S.-embargoed country and are not on a U.S. prohibited-party list.
We may update these Terms. We will communicate material changes, and continued use after the effective date means you accept the updated Terms.
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules, and the state and federal courts located in Texas will have jurisdiction over any dispute, except where applicable law requires otherwise.
